Guidelines and rules for using the Load Flight system
LOAD FLIGHT VIRTUAL FLIGHT MANAGEMENT LTDA (Brazilian company registration/CNPJ No. 67.971.785/0001-10), hereinafter referred to as "Load Flight" or the "Company," provides the "Load Flight" flight simulation and virtual airline management platform (the "Platform"), governed by these Terms and Conditions of Use ("Terms"), which are binding between the Company and every user who registers for or uses the Platform (the "User"). For the purposes of these Terms, "Virtual Items" means any virtual currency, license, aircraft, module, or digital item made available within the Platform; "Coins" means the internal, closed-loop virtual currency with no legal tender status used to acquire Virtual Items within the Platform; "P2P Marketplace" means the area of the Platform where Users may list and acquire Coins from one another through the Company's intermediation; and "Payouts" means any amounts that may be paid to Users under Clause 17. Registering for and using the Platform presupposes reading, understanding, and fully and unreservedly accepting these Terms.
The relationship between the User and the Company is strictly civil in nature, arising from a license to use entertainment and simulation software. Use of the Platform, participation in events, ATC sessions, the Affiliate Program, or the possible receipt of Payouts does not, under any circumstances, constitute an employment, corporate, commercial agency, partnership, or any other relationship giving rise to subordination, recurring paid work, or economic dependence between the User and the Company. Any amounts paid to Users are in the nature of bonuses and prizes within the Platform's gamification dynamics, and do not constitute salary, compensation, commission in the labor-law sense, or any other form of remuneration subject to labor legislation.
By registering, the User declares and warrants that they have full legal capacity and that all information provided is true, accurate, current, and complete, and undertakes to keep it up to date. The Company has no duty to verify registration data in advance and may, at any time, require proof of accuracy and suspend accounts whose data proves false, incomplete, or outdated, without any liability or duty to indemnify.
Exploiting system vulnerabilities, using hacks, cheats, unauthorized time accelerators, reverse engineering, or any attempt to manipulate flight logs, virtual balances, or reward mechanisms will result in an immediate and permanent pilot ban, device lock (HWID Ban), and the full forfeiture — without any refund or compensation — of all balances, virtual currency, licenses, and items associated with the account, without prejudice to any applicable civil or criminal action.
The Load Flight ecosystem is designed exclusively for flight simulation and virtual airline management. Using the platform for divergent commercial purposes, reverse engineering, malicious automation, scraping, or unauthorized data extraction is strictly prohibited and may result in immediate account ban and civil or criminal liability for the offending user, regardless of prior notice.
Registration data (such as email and phone number) will be used for authentication, account security, institutional communications, and other legitimate purposes related to the operation, analysis, and improvement of the platform, in accordance with Brazil's General Data Protection Law (LGPD — Law No. 13,709/2018). Anonymized or aggregated data may be freely used by the company, including for statistical and commercial purposes, without restriction. Users may exercise their rights under the LGPD through the official support channels, subject to the company's internal timelines and procedures.
By turning on the Multiplay Load Flight feature while a Load Flight flight is in progress outside the online networks (IVAO or VATSIM), the User authorizes the following flight data to be shared in real time with other users of the feature who are nearby: dispatch callsign, aircraft type, airline, position, altitude, speed, heading and the state of the landing gear, lights and flaps. No registration, contact or financial data of the account is shared. Positions pass through a relay server and are not kept as history by this feature. The User may stop sharing at any time by turning the feature off in the application's Preferences. Load Flight may suspend access to the feature, independently of the account, in case of misuse, such as an offensive callsign, abusive repositioning or interference with other users' traffic.
Use of the platform is restricted to individuals 18 years of age or older, due to the interactive video conference and audio features of the Flight Academy and ATC sessions. Registration is based on the user's own declaration of legal age, and the user bears sole and exclusive responsibility for the accuracy of that declaration. Load Flight has no obligation to verify age and bears no liability whatsoever for the registration of a minor made through a false declaration.
The platform is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of continuous availability, error-free operation, or fitness for a particular purpose. Under no circumstances shall Load Flight, its partners, developers, administrators, or staff be liable for indirect or incidental damages, lost profits, or loss of data or virtual balance arising from the use or inability to use the platform. Should any liability of the company nonetheless be judicially recognized, it shall in any case be limited to the amount actually paid by the user to the platform in the 3 (three) months preceding the event giving rise to the claim.
The Platform does not guarantee, under any circumstances, income, earnings, financial results, or any type of return to the User. Awards, prizes, affiliate commissions, and Payouts depend entirely on the eligibility rules in effect at any given time, which may be changed, suspended, or discontinued at the Company's sole discretion, without giving rise to any vested right, indemnity, or compensation to the User.
Load Flight is not responsible for agreements, negotiations, or transactions conducted between users outside the Platform's official P2P Marketplace or in breach of its rules, including but not limited to off-system buy/sell arrangements, disputes, or inappropriate conduct. Full liability for any violation lies solely with the offending user. The user agrees to defend, indemnify, and hold Load Flight harmless from any claim, damage, loss, or expense (including attorneys' fees) arising from the user's conduct, use of the platform, or breach of these Terms.
Before purchasing licenses, aircraft, modules, virtual currency or other digital items, the User must review the description, usage requirements, compatibility, price and validity periods stated in the offer. Purchasing a module and purchasing or renewing a license are separate transactions, unless expressly bundled in the offer. If in doubt, the User may contact support and, when eligible, use the free 15-day trial. Cancellation and refund requests will be assessed under applicable law, the offer conditions and payment-provider rules, without prejudice to statutory consumer rights, including the right of withdrawal where applicable. Merely making a digital item available or crediting it to an account does not, by itself, waive those rights. Any additional commercial concessions do not change usage requirements or promise future concessions.
TO USE ANY LOAD FLIGHT MODULE, THE USER MUST MAINTAIN AT LEAST ONE ACTIVE LICENSE ON THE PLATFORM, OR BE WITHIN A VALID VIP TRIAL PERIOD. An active license is a qualification registered to the User's account that has not expired; pilot or controller licenses satisfy this requirement. A license does not mean a Coins or Dollars balance. BUYING A MODULE DOES NOT INCLUDE, RENEW OR REPLACE A LICENSE, unless expressly bundled in the offer. The cost of purchasing or renewing a license is separate from the module price. A module may be purchased before a license, but cannot be used until this requirement is met. The 15-day VIP trial temporarily waives the license requirement only while valid; once the VIP trial ends or is cancelled, use requires an active license and purchased access to the module. If the last license expires and no valid VIP trial exists, module usage is suspended, including for modules already purchased. A purchased module remains linked to the account, subject to the other provisions of these Terms, and can be used again after a license is activated or renewed, without buying the same module again. The absence or expiry of a license, where the requirement was disclosed before purchase, does not, by itself, constitute a module defect or trigger an automatic refund; the statutory consumer rights stated in Clause 10 remain protected. This condition applies to all current and future modules in addition to each product's technical and compatibility requirements. This wording does not retroactively waive rights relating to earlier purchases.
Load Flight bears no liability whatsoever for security failures originating on the user's own computer, device, network, or credentials, including intrusions, viruses, keyloggers, phishing, or password sharing, even where these result in financial loss or loss of virtual items. Safeguarding access credentials is the user's sole responsibility.
Coins constitute a virtual currency restricted to the Load Flight ecosystem, with no legal tender status and no relation to crypto-assets, foreign currencies, or financial instruments regulated by the Central Bank of Brazil or the Brazilian Securities Commission (CVM). Coins and other Virtual Items are not the User's property in the civil-law sense, but are subject to a personal, revocable, non-transferable license to use, whose value is exclusively internal to the Platform. The platform may, at any time and at its sole discretion, change prices, create, modify, limit, or discontinue Coins, licenses, features, or any Virtual Item, without prior notice and without giving rise to any right to a refund, compensation, or indemnity for the User. Coins cannot be redeemed directly for cash by the Company; their only avenue for conversion into monetary value is resale through the P2P Marketplace, under Clause 13.
The Platform provides an environment (the "P2P Marketplace") in which the User may list Coins they own for sale to other Users, at a price in US dollars freely set within the minimum and maximum limits calculated by the Platform. The Company acts solely as the technological intermediary bringing seller and buyer together, processing payment through the Xsolla provider and retaining an intermediation fee (currently set in system configuration, subject to change at the Company's discretion) on the value of each completed sale. The Company is not a party to the purchase-and-sale relationship between Users, does not guarantee the completion, price, liquidity, or desirability of any listing, and bears no liability for losses arising from the P2P Marketplace's own supply-and-demand dynamics.
Coin purchases in the P2P Marketplace are processed via Xsolla and, once completed, result in the immediate transfer of Coins to the buyer and of Payouts to the seller. Should the Company identify or be notified of fraud, a refund, a chargeback, a payment dispute, or any reversal of the underlying transaction processed by the payment provider, the Company may, at its sole discretion and without prior notice: (i) reverse the transaction, debiting Coins and/or Payouts from the accounts of the buyer and/or seller involved, even where such amounts have already been partially or fully used, converted, or withdrawn; (ii) require the benefiting User to return the corresponding amounts; (iii) suspend or ban the accounts involved, under Clause 3. The User acknowledges that the reversal of a payment after the corresponding Payout has already been withdrawn creates a debt owed to the Company, subject to applicable collection measures.
Without prejudice to the other provisions of these Terms, the Company reserves the right, at any time, to require proof of identity and source of funds from Users whose volume, frequency, or pattern of transactions in the P2P Marketplace or of withdrawal requests is deemed atypical, and may preventively suspend the account, withhold Coins, Virtual Items, and Payouts, and report to the competent authorities any indication of money laundering, terrorist financing, or fraud, as required by applicable law, without this giving rise to any liability or duty to indemnify on the Company's part.
The Company does not guarantee the existence of buyers or sellers for any listing in the P2P Marketplace, nor the maintenance, stability, or appreciation of the market price of Coins. Any lack of liquidity, price fluctuation, or inability to sell the User's Coins does not give rise to any right to indemnity, repurchase, or compensation by the Company.
Payouts, when due, are processed on the 25th of each month; this schedule may be changed at the company's discretion upon notice through official channels. If the user has changed the email address registered on their account, the deadline will be extended by 5 (five) additional days as an anti-fraud security measure. Payment delays do not give rise to interest, monetary correction, or any indemnity in favor of the user.
Payouts are made exclusively via PayPal, and it is the user's sole responsibility to hold a valid, active account to receive payments, bearing any fees charged by PayPal itself. The platform may, at its sole discretion, withhold, suspend, cancel, or request additional documentation for any withdrawal request, for an indefinite period, in cases of suspected fraud, balance manipulation, chargebacks, or misuse of the system, without this giving rise to any liability, interest, or indemnity on the company's part. Determining and paying any taxes due on amounts received is the user's sole and full responsibility, and the company bears no tax liability whatsoever, present or future, related to such amounts.
Accounts with no access or activity for a period exceeding 24 (twenty-four) consecutive months may be deemed inactive, and the Company is authorized to suspend access, cancel active P2P Marketplace listings, and, after attempting to notify the registered email, close the account along with its Coin and Virtual Item balances, which do not give rise to any right to a refund or indemnity. Payouts pending withdrawal in an account deemed inactive follow the statute-of-limitations rules under applicable law.
Load Flight may suspend, limit, or terminate any user's access to the platform, at its sole discretion, with or without cause, with or without prior notice. In any case of suspension or termination — including at the company's discretionary decision — virtual currency balances, licenses, and other digital items are forfeited in full, with no right to refund or compensation of any kind. Withdrawal requests pending as of the suspension date may be cancelled at the company's discretion.
The User represents, under their sole responsibility, that all information provided at registration and during the use of the Platform is true, accurate, current and their own. Accounts presenting divergent, inconsistent, false or suspicious data, as determined by Load Flight's security mechanisms, will be banned automatically, at any time and without prior warning or notice. This includes, without limitation: registration information that is inconsistent with itself; devices, networks or identifiers linked to previously banned accounts; and signs of multiple accounts held by the same person. Test accounts and accounts created with fictitious or third-party data go through the same filters and are subject to the same penalties, including a ban without prior warning.
A ban applies to the User as a person, and not only to the account in which the violation was found. Accordingly, the penalty automatically extends to any account linked to the banned User, whether existing or created in the future, by any means, device or registration data, and the User is barred from returning to the Platform. A ban is final, permanent and irrevocable, and is not subject to review, reversal or expiration. To ensure compliance with this clause, the User acknowledges and authorizes Load Flight to retain, for an indefinite period, the registration and technical data of banned accounts (such as e-mail address, device identifiers and network addresses). Such data will be used exclusively for security and fraud-prevention purposes, pursuant to the Brazilian General Data Protection Law (Law No. 13,709/2018).
The user agrees to maintain respectful conduct in chats, Flight Academy audio/video sessions, ATC sessions, and other interactive spaces on the platform. The company is the sole and exclusive judge of what constitutes a violation of this clause and may suspend or ban the account immediately, without the need for prior notice or a detailed justification.
The Company may monitor, log, and audit, at any time and without prior notice, the User's activity on the Platform, including chat messages, audio/video sessions, transactions, and flight telemetry, for purposes of security, fraud prevention, and compliance with these Terms and applicable law. The User acknowledges and consents to such monitoring as a condition of using the Platform.
The software, the "Load Flight" brand, layout, text, icons, source code, and other platform elements are the exclusive property of Load Flight Virtual Flight Management LTDA. Use of the system grants the user only a personal, revocable, non-exclusive, non-transferable license, and does not constitute an assignment of any right. Any suggestion, idea, feedback, or content submitted by the user to the company may be freely used, reproduced, and exploited by the company, with no obligation of credit or compensation to the user.
Participation in the affiliate program is granted at the company's discretion, not as a vested right, and is subject to the eligibility and commission-calculation rules in effect at any given time, which may be changed or discontinued at any time, without prior notice and without giving rise to any indemnity. Commissions arising from fraudulent referrals, duplicate accounts, or misuse of the system will be reversed or cancelled at the company's sole discretion, even if already credited.
Load Flight integrates with third-party services (flight simulators, PayPal, Xsolla, cloud providers, among others), without any affiliation or joint liability with these providers. The company bears no liability whatsoever for the unavailability, instability, modification, or discontinuation of third-party services.
The Company shall not be liable for delays, failures, or interruptions in service arising from an event of force majeure or acts of God, including, without limitation, connectivity failures, third-party cyberattacks, unavailability of infrastructure providers, acts of public authority, strikes, pandemics, or any event beyond its reasonable will and control.
Technical, commercial, strategic, or operational information of the Company to which the User gains access through use of the Platform is confidential, and its disclosure, reproduction, or use for purposes other than those set out in these Terms is prohibited, subject to civil and, where applicable, criminal liability.
Any communication from the Company to the User shall be deemed valid and effective when made by registered email, in-platform notification, or posting on official channels; it is the User's burden to keep their contact information up to date and to check such communications regularly.
These Terms may be unilaterally amended by the company at any time and at its sole discretion, becoming effective immediately upon posting on the platform. It is the user's responsibility to periodically review this page. Continued use of the platform after any change constitutes full and unrestricted acceptance of the new Terms; if the user does not agree, their sole remedy is to stop using the platform.
The parties undertake to make their best efforts to resolve, amicably and within up to 30 (thirty) days, any dispute related to these Terms, by contacting the Company's official support channels, before resorting to any judicial or extrajudicial measure, except in cases of urgency or of non-waivable rights.
The Company's tolerance of any breach of these Terms does not constitute a waiver of its right to enforce that provision at any time. Should any provision be held invalid or unenforceable, it shall be interpreted so as to preserve its original purpose as closely as possible, with all remaining provisions remaining in full force and effect. These Terms constitute the entire agreement between the parties with respect to their subject matter, superseding any prior understandings, negotiations, or agreements, whether verbal or written.
The company may freely assign or transfer these Terms and the operation of the platform to third parties, including in the event of corporate reorganization, merger, acquisition, or sale of assets, without requiring the user's consent. The user may not assign or transfer their account or any rights under these Terms without the company's prior written authorization.
Acceptance of these Terms, given electronically at the time of registration or upon a version update, is fully legally valid as an expression of will under Brazilian law applicable to electronic legal transactions, and does not require a physical signature. These Terms remain in effect for an indefinite period, for as long as the User maintains an active account on the Platform.
These Terms are originally drafted in Portuguese. Versions in other languages are made available solely for the User's convenience; in the event of any discrepancy, doubt, or conflict of interpretation between versions, the Portuguese version shall prevail in full.
These Terms are governed exclusively by the laws of the Federative Republic of Brazil. The courts of the Comarca of Curitiba, State of Paraná, are elected to resolve any disputes arising from these Terms, with express waiver of any other venue, however privileged, except where a mandatory venue is required by law.
